FAQ: Can I hire a new lawyer?

Question: When I was involved in a car accident, I hired an attorney. I have had a disagreement with my attorney. Now I want to find a new attorney. Can I?

The simple answer is: yes. You can fire your attorney. Your attorney may be entitled to get paid the reasonable value of his services for work he has done from the time he started representing you until the present. Your new attorney and your current attorney would then share the fee.  Usually, the attorneys figure this out and it has no effect on you. However, be aware, this may make other attorneys less likely to take your case.

I tell everyone who calls me who has a current attorney to send a letter to the attorney and ask for an appointment to discuss the case. Sometimes, an email to the attorney directly will work as well. I try to shy away from a call to the attorney because I don’t know if the attorney will get the message. While I answer my own phone, most attorneys still do not answer their own phones.

When you meet with your current attorney, let him know you are not happy and see what he says. Be specific in what you are not happy with. You hired him for a reason so you should not be so quick to fire him. Give him (or her) a chance to fix the problems.
