California Debt Blog: FAQ: Its not my debt. What do I do?

Q: Someone ran up charges on a credit card debt. Now they are coming after me for the money. It is not my debt. They say they are going to freeze my account. What do I do?

A:  A lot has to happen first before they can freeze your account. First, they would have to sue you. Then they would have to get a judgment. Then, they could garnish your bank account. ‘

What should you do? First, you need to challenge this with the credit card company. Ask them for the affidavit  (they all have one), complete it and send it in to them. Tell them that the account is not yours. Notify the credit card company, the collection agency and all of the credit bureaus. Dispute this with them on the grounds that it is not your debt.
