California Debt Blog: FAQ: I paid off a debt and then I got sued on it. What do I do?

January 22, 2007 by Jonathan Stein

Q: I paid off a debt. I was then sued for that same debt. What do I do?

A: You may have a case against the attorney and the debt collector who filed the lawsuit for violations of the FDCPA and the California’s Rosenthal FDCPA. You should get a copy of the complaint and obtain any documents you have that show you paid the debt off. Then talk to an attorney about whether there are violations or send your documents to the attorney who filed the case and ask him to dismiss it immediately. Remember, though, that you only have 30 days to answer the complaint!
