Obtaining Information on the Other Party

January 6, 2006 by Jonathan Stein

So you get in an accident. You do everything I suggested on my personal injury podcast. The other person refuses to identify him or herself. What do you do?

In California, you file a form with DMV. The form requests the information on the other party. You can either fill it out for the driver’s information, if you have a driver’s license. Or, you can request vehicle owner information if you have the license plate.

Before you get to this step, you should call the police at the scene of the accident if the other person refuses to give you their information. It is illegal not to provide your information if you are in an accident. The police do investigate these things as it is usually a sign of other problems with the person.

But, when all else fails, the DMV form comes in handy.
