Is there a Statute of Limitations on Claims?

Someone asked me this recently. What are the statues of limitation on a theft claim to an insurance company?

Let me share my answer. The statute of limitations deals with filing a lawsuit, or in some instances, a claim. So, the answer would be none.

However, if you mean how long do you have to report your claim, it depends. Your policy says that you must give “prompt notice” to the insurance company. When I was an insurance adjuster, that was usually within 30 days, but the circumstances of each claim are different.

If you mean how long do you have to sue the insurance company, you have, generally, two years from the date of the loss. But, you have to comply wtih all of the conditions of the policy first.

I hope that brings a little clarity to filing claims and suing your insurance company (which we will get into another time!)
