Amazing story over at Caveat Emptor. Unifund gave him documents showing that they file 14,172 collection lawsuits from January 1, 2004 through July 31, 2006. According to Caveat Emptor, that is 450 lawsuits per month. Of that, almost 9,000 resulted in default judgments. WOW! Thats a 63.5% rate. Almost 1/3 were dismissed.
Moral of the story: talk to an attorney when you are first sued by a debt collector. The advice may be that you owe the debt, pay it and move on with life. But, you may have a valid defense or a claim against the debt collector. You need to know your rights and it makes a HUGE difference.
