California Debt Blog: When to call an attorney

I am amazed at the number of telephone calls I get from people who have debt issues. I get several phone calls per day. Unfortunately, some of these people I cannot help. Why?

The biggest reason: they wait too long to call my office.

The best time to call: when you get your first letter from a collection agency. That allows you to get a consultation, learn your options, and determine if you should hire an attorney or try to deal with the debt collection agency yourself. The consultation is free and there are times when I tell people how to resolve it without hiring me. Then there are times when I agree to represent someone at no cost to them.

The worst time to call: after a judgment has been entered against you. Generally, you only have six months after a judgment has been entered to have it set aside. The longer you wait, the harder it is to have it set aside. After six months, it is almost impossible to have a judgment set aside.

Don’t wait. When you get that first letter, or when you know you are having problems, call an attorney. It will be worth your time to learn your rights sooner rather than later.
