If A Tree Falls On Your Car, and No One Cuts It Down, Who’s Liable?

My apologies to the tree that fell in the forest with no one around to hear it. But, what happens when a tree is blown over on your house or your car?

If a healthy tree blows over due to wind and rain, this is generally considered an Act of God. As such, the tree’s ownerwould generally not be responsible. You should consider filing an insuranec claim with your auto company (if you have comprehensive) or your homeowners company. If the tree is not healthy, then you might have a case against the tree owner. Try to get the tree inspected by an arborist before it is taken away.
