Another Attempt to Limit Damages

March 3, 2006 by Jonathan Stein

The Civil Justice Association of California is at it again. This time they are circulating a petition that would limit your right to recover punitive damages. Here is an excerpt:

The Civil Justice Assn. of CA is collecting signatures for a ballot measure that would eliminate punitive damages in product liability cases where the manufacturer obtained state or federal approval for their product. However, it will exempt manufacturers that withhold information from regulators. The oil industry is already backing the measure and other major industries are considering the issue.

Punitive damages are designed to punish defendants. In some cases, most of the verdict is punitive damages. Think Ford Pinto. If this is successful, it will again protect business at the expense of consumers.

This is a bad petition and one that you should not sign, in my opinion. It only protects big business.
