Another Study Determines Caps Don’t Work

Ken Shigley over at the Atlanta Injury Law Blog posts about another study debunking the myth about caps and tort reform. As Ken put it, there is “little or no relationship between the level of medical malpractice payments and the measures used by the insurance industry to promote limits on individual rights.”

I keep saying it and I feel like a broken record. The insurance company is pulling the wool over the eyes of the American public. If you want lower insurance premiums, tort reform, caps, civil litigation reform, etc… is not the way to do it. The way to get lower insurance premiums is for the insurance industry to stop gouging people.

And if the insurance companies want to make more money, here is a very novel idea:

PAY WHAT YOU OWE AND TREAT PEOPLE RIGHT!

There. Was that so hard? Instead of jerking with people, treat people right, pay what you owe, and stop forcing people to sue you and your insureds to get what they are entitled to.
